Terms & Conditions

These Terms and Conditions govern your use of noxus.co.za and any purchase you make from NOXUS PTY LTD (registration number [REG NO]), trading as Noxus ("we", "us"). By using this site or placing an order, you agree to these terms. They are provided in accordance with the Electronic Communications and Transactions Act 25 of 2002 (ECTA) and the Consumer Protection Act 68 of 2008 (CPA).

2. Orders and contract formation

Displaying products on the site is an invitation to do business, not an offer. Your order is an offer to buy. A binding sale only forms once we send you an order confirmation and payment has been authorised. We may decline or cancel an order (for example, where stock is unavailable, a pricing error has occurred, or payment cannot be verified), in which case we will refund any amount already paid.

3. Pricing and payment

All prices are in South African Rand (ZAR) and include VAT where applicable. We take reasonable care to price products correctly, but where an obvious error occurs we are not obliged to honour it. Payment is processed securely through our payment provider; card details are entered in the provider's secure environment and are not stored by us. See Payment & Security.

4. Delivery

Delivery timeframes, areas and costs are set out on our Shipping & Delivery page. Risk in the goods passes to you on delivery. Ownership passes once payment has cleared in full.

5. Returns, cancellation and refunds

Under ECTA you may cancel certain electronic transactions within 7 days without reason, and the CPA gives you rights in respect of defective goods. The full process, timeframes and exclusions are set out in our Returns & Refunds policy, which forms part of these terms.

6. Warranties

Products carry the manufacturer's warranty and the implied warranty of quality under the CPA. Warranty claims are handled as described in the Returns policy. Warranties do not cover damage from misuse, accident, unauthorised repair or normal wear.

7. Acceptable use and accounts

You are responsible for keeping your account credentials secure and for activity under your account. You may not use the site unlawfully, attempt to interfere with its operation, or infringe our or others' intellectual property.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect or consequential loss. Nothing in these terms limits liability that cannot lawfully be limited, including under the CPA.

9. Governing law

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction.
